Welcome to HRConsulta. These Terms of Service (“Terms”) outline the rules and conditions that govern your use of our platform, products, and services. Please read them carefully.
By accessing or using HRConsulta (“Platform”), operated by PT Consulta Digital Indonesia (referred to as “HRC”, “we”, “our”, or “us”), you agree to be bound by these Terms.
If you do not agree with any part of these Terms, you should not use our services.
1. About HRConsulta
HRConsulta is a digital platform operated by PT Consulta Digital Indonesia, providing practical, editable, and implementation-ready HR compliance deliverables through a structured gig-based service model.
We specialize in:
- Employment Contract Reviews (PKWT/PKWTT)
- Company Regulations (PP) and Collective Labor Agreements (PKB)
- HR Policy Reviews and Employee Handbooks
- Onboarding & Offboarding Kits
All services are handled by our in-house HR consultant team.
2. Legal Disclaimer
- HRConsulta is not a law firm and does not provide legal advice.
- While our services align with Indonesian labor regulations and compliance standards, our content and deliverables are for general informational and operational use only.
- Nothing on our platform or in our deliverables should be considered a legal opinion or substitute for professional legal counsel.
- For matters requiring legal interpretation, enforcement, litigation, or arbitration, we strongly recommend that clients consult a licensed labor law attorney.
3. Who Can Use This Platform
To use HRConsulta:
- You must be at least 18 years old.
- You must have authority to act on behalf of your company or organization.
- You agree to provide accurate information for your account, orders, and service intake.
We reserve the right to refuse access or services to anyone who violates these terms.
4. How Our Gigs Work
- Each gig listed on the platform has a clear scope, timeline, deliverables, and pricing.
- Gigs include three tiers (Basic, Pro, Premium) with predefined features. You choose a tier, complete an intake form, and upload relevant documents (if required).
After purchase:
- The HRC consultant team begins work based on the information you provide.
- Deliverables are sent digitally in formats such as DOCX, XLSX, PDF, or PPTX.
- All communication takes place through your client dashboard or registered email.
5. What You Must Provide
To begin work, clients must submit or upload all necessary documents and data, which may include:
- Existing HR policies, regulations, or employment contracts
- Organizational structure or employee categories
- Business needs, goals, and legal considerations
- Specific requests related to labor union clauses, company-specific conditions, etc.
HRC is not responsible for delays or incorrect output resulting from incomplete, inaccurate, or outdated information provided by the client.
6. Delivery Timeline
Each gig has a clearly stated timeline. Timelines begin once all required inputs are received.
Delivery includes:
- Editable, implementation-ready files
- 1 round of minor revision (unless otherwise stated)
If the scope changes after project kickoff, new timelines and fees may apply.
7. Intellectual Property
- All tools, frameworks, and document structures used in service delivery are the intellectual property of PT Consulta Digital Indonesia.
- Clients receive a non-exclusive, non-transferable license to use the deliverables for internal business use only.
- You may not resell, repackage, publish, or redistribute any part of our deliverables without written permission.
8. Payments
All prices are displayed in Indonesian Rupiah (IDR) or USD. Payment is required upfront via our secure payment gateway.
Once payment is completed:
- Your order is confirmed and work begins based on the gig tier you selected.
- An official invoice will be available in your dashboard.
- We do not store or process payment information directly.
9. Refund Policy
Refunds may be issued under these conditions:
- You cancel your order within 24 hours and work has not started.
- HRC is unable to deliver the promised service and no alternative solution is provided.
Refunds are not granted:
- Once the first version of a deliverable has been submitted.
- If delays are caused by client-side issues (e.g. missing information, change of scope).
- For subjective dissatisfaction not tied to non-delivery or gross deviation from scope.
Partial refunds may be granted at HRC’s discretion on a case-by-case basis.
10. Communication & Support
- Clients can contact the HRC team before or after placing an order by using the “Contact Us” button on the gig page or through our main contact form.
- All service-related communication must be recorded within the platform or email for transparency and support.
11. Confidentiality
All information shared by the client is treated as confidential. We do not share, sell, or disclose any client data or documentation with third parties without your consent, unless legally required.
12. Prohibited Use
Clients may not use our platform or services to:
- Engage in illegal, discriminatory, or unethical employment practices
- Copy or reverse-engineer HRC materials for commercial resale
- Submit misleading, fraudulent, or harmful content
- Misrepresent your authority or act on behalf of a company without consent
Violations may result in immediate account suspension and legal action.
13. Platform Availability
- We strive to keep HRConsulta accessible and fully functional. However, we cannot guarantee uninterrupted access due to maintenance, upgrades, or unforeseen technical issues.
- We are not liable for any business loss or damages caused by temporary service disruptions.
14. Modification of Services
We may update, modify, or discontinue gigs or features at any time. Clients will be informed if an active gig is affected.
15. Limitation of Liability
To the maximum extent permitted by law:
- HRC is not liable for any indirect, incidental, or consequential damages arising from your use of the platform or services.
- Our total liability shall not exceed the amount paid by the client for the specific gig in question.
16. Governing Law & Jurisdiction
- These Terms are governed by the laws of the Republic of Indonesia.
- Any dispute shall be settled through negotiation. If unresolved, disputes shall be submitted to the exclusive jurisdiction of the courts in Jakarta Selatan.
17. Updates to Terms
- We may update these Terms periodically. The latest version will always be available on the platform.
- You are responsible for reviewing the Terms before placing an order. Continued use of our services constitutes acceptance of the revised Terms.
